CAN HOME FORECLOSURE BE PREVENTED ? (Florida)
When you file for protection in Bankruptcy, the mortgage holder cannot file a foreclosure suit without permission from the Court. If a foreclosure has already been started, the bankruptcy freezes it. A Chapter 7 will give you the chance to get caught up or work something out with your mortgage holder. Often a plan can be worked out so you don't loose your house. In Chapter 13 the back payments are put into a payment plan the allows you to get caught up over a three to five years period. One good piece of advice. When you have to make a choice between your house payment and credit cards, forget the cards, pay the mortgage. Return To Main Menu |
