CAN HOME FORECLOSURE BE PREVENTED ? (Florida)


When you get behind on your house payments, the mortgage holder can foreclose on your property. At some point they will stop accepting payments unless you make all the back payments at once.

When you file for protection in Bankruptcy, the mortgage holder cannot file a foreclosure suit without permission from the Court. If a foreclosure has already been started, the bankruptcy freezes it.

A Chapter 7 will give you the chance to get caught up or work something out with your mortgage holder. Often a plan can be worked out so you don't loose your house.

In Chapter 13 the back payments are put into a payment plan the allows you to get caught up over a three to five years period.

One good piece of advice. When you have to make a choice between your house payment and credit cards, forget the cards, pay the mortgage.
