How Will It Affect My Spouse's Credit (Florida)


Usually it won't.
Just because you file a Bankruptcy, your spouse's credit isn't automatically affected.
In Florida , a Bankruptcy will affect only the creditors your name is on. So, if an account is in your name only, the creditor has no legal right to ask for payment from your spouse. But, if its a joint account with both names on it, and only you file bankruptcy, the creditor can continue to try to collect from your spouse.
If, however, your spouse is only what's called an "authorized user" of the account, like with credit cards, your spouse is protected.
